Judge calls mistrial in Vikki Macias case

A judge has declared a mistrial for the case of a woman accused of murdering her 4-year-old son. 

Vikki Macias, 27, was arrested last March after her son was pronounced dead at University Medical Center. An autopsy showed he died from blunt force trauma to the head and also uncovered a broken shinbone that went untreated. 

Macias was in court Tuesday morning when a veteran detective with the El Paso Police Department broke down and cried in front of the jury. 

"I apologize..." the detective said while on the stand. "It's unprofessional." 

Judge Gonzalo Garcia was not pleased with the detective's behavior. 

"Are you kidding me?" Garcia said in court. "(To prosecution) talk to your witness… That's ridiculous." 

The trial will likely be rescheduled for June, and the defense said that they want Macias to be let go on bond. 

The defense said they will file the paperwork later this week.

Drive-by shooting leaves car riddled with bullets

An East El Paso street was closed off for hours while police investigated a drive-by shooting Monday.

The shooting happened at about 9:45 p.m. in the 3200 block of Orkney Road, which is just a few blocks from Eastwood Park, commonly known as Album Park.

No one was hurt but police said a car was riddled with bullets.

A couple of younger residents could not return to their homes since police had the street taped off. People inside their homes were told to remain inside.

People who live in the area said the neighborhood is usually very quiet and is a retirement community.

Northeast City Leaders Plan to Improve Safety

EL PASO, TEXAS -- Two children died and two more remain in the hospital after they were hit by a car as they walked along the shoulder of Dyer Street in Northeast El Paso on Saturday.

Their neighbor, Claude Ficca, is not shy about his opinion of the street he calls home. "This area out here is very unsafe," he said.

Ficca lost his son James on the same stretch of road twenty years ago. He has a list of improvements he'd like to see happen to make the area safer. "Have some lights put up or caution, reduced speeds at night. This area is very dangerous," he said.

City Councilman of District Four tells KFOX14 he's always known Dyer street was dangerous. "I've always said that it was an accident waiting to happen in that area. I'm sad to say it did happen but we are aggressively working on that issue," he said.

Robinson said he has spent two years trying to improve the area. He has worked to get a traffic light installed and requested the speed limit be reduced from 55 mph to 45 mph. He explained changes must go through TxDot because Dyer is not a city street.

Robinson said a traffic light was approved and neighbors can expect to see the new light at the intersection of Dyer and Angora Loop before the end of the year.

He knows the safety improvements can't change what happened Saturday. "My condolences go out to the family of those young kids that got killed its very unfortunate that an incident like that occurred," he said.

But he encourages concerned citizens to get involved in local government to make change happen.

"Don't wait till the accident occurs. If they see something that is of an issue as far as public safety I encourage them to call. You know, call my office. Call the police department," he said. "I assure you that we take action and respond to the requests but we need to hear from the citizens," he said.

Motorcycle crash sends man to hospital with serious injuries

A two-vehicle crash at Hunter Drive and Alpine Drive, in El Paso's Lower Valley, sends one man to the hospital with serious injuries Monday night.

Bridgett Romero, 18, was driving a full-sized SUV south, in the left lane, on Hunter Drive. According to her, the motorcycle driver was trying to pass her on the left by crossing the double yellow line. Romero tried to turn left on Alpine and the Vehicles' collided.

"That's when he hit me and he flew," Romero said.

Romero was visibly shaken when she spoke with KFOX14 News but she was not hurt.

Police don't know if the motorcycle driver will live. Police also don't know yet whether alcohol or speed were factors in the wreck.

KFOX14 investigates alleged bouncer misconduct at local nightclubs

KFOX14 tracking what could be an uptick in alleged bouncer misconduct at local clubs and bars. When we checked the Texas Penal Code, it turns out many bouncers are on the wrong side of the law.

Lifelong El Pasoan Victor Alonzo said he was an alleged victim of bouncer misconduct more than two years ago at The Plum, a downtown El Paso club.

"It was so fast that I just remember hitting the floor," Alonzo said. "I just remember protecting my face. I was just kind the first instinct: To protect my face."

He said he awoke to the sensation of being covered in blood.

Alonzo said it was 1:45 a.m. and his girlfriend, now wife, needed to use the restroom. The bouncers allegedly told them they needed to leave right away.

"We had kind of an exchange of words," Alonzo said.

Alonzo says that exchange turned into a violent attack, leaving him with a dislocated shoulder, and a fractured face and eye. His eye still shows signs of trauma.

"You know, two guys? It was really one on five,” Alonzo said. “What was I going to do? I didn't lay a punch…I didn't even swing a punch."

Connie Quintero is an El Paso attorney representing Alonzo and another client in a lawsuit against The Plum for bouncer misconduct in two separate incidents.

"I think these patrons see the bouncers as people that are going to protect them, and I think it's on the contrary," Quintero said. "…They [local nightclubs] hire these people off the street, and really they're not doing anything wrong because our city, our community, has not required them to provide any kind of training to their bouncers."

Back in February, The Plum’s owner, Rafael Arellano, told KFOX14 that the club does conduct bouncer background check, and said previous incidents KFOX14 reported on did not occur.

However, in years of research, Quintero said the club has been unable to provide even so much as a personnel file for the bouncer who allegedly attacked Alonzo.

"They have no documentation about how he was trained, where he was trained, not even his address," Quintero said.

Quintero says in many of the cases she's seen, the club will come to the alleged victim, telling them they were disorderly and drunk. She said they said on occasion, that's why the clubs said their bouncers were forced to get physical with patrons.

And while Quintero said that may be true in some cases, in many cases it is not true.”

"From the very natures of a nightclub, there are going to be intoxicated individuals,” Quintero said. “I think what's happening is they're not training their bouncers on how to deal with those people when they leave."

In conversations KFOX14 had with local club owners and managers, as well as Quintero, we have found it's up to each club to come up with their own "code of conduct" concerning bouncers. It's also up to the club to enforce it.

But can bouncers actually get physical with a patron? Do they have those special rights? The El Paso Police Department said no. They said laws apply to bouncers the same way they apply to anyone else.

Authorities told KFOX14 that bouncers are not allowed to assault patrons even if they are rowdy, screaming or yelling.

According to the Texas Penal Code, the use of force against another is not justified in response to verbal provocation alone.

"These business owners need to be aware that the bouncers need training,” Quintero said. “Training on how to deal with intoxicated people, training on how to escort the patrons out and how they need to be escorted."

“They have no right to touch you,” Alonzo said. “Their job is to get you out of the club.”
